The report on Access to Justice submitted to the
Chancellor by Lord Woolf on 26th July 1996 was accompanied by a draft the
common core of the Civil Proceedings Rules. Preceding this the Lord Chancellor's
department had issued a guide on Alternative Dispute Resolution (ADR) entitled
Resolving disputes without going to Court.
The spirit behind the proposed legislation was to encourage opposing parties to avoid litigation in cases of dispute wherever possible and to reduce the cost, complexity and duration of litigation that had not been avoided by resorting to Alternative Dispute Resolution. Through a network of experts qualified in the fields of investigation, mediation and arbitration Cavendish Legal and Dispute Resolution Services (CL&DRS) of which Hinkson Associates is a member can provide objective external assistance with any search for fair and amicable solutions to cases of dispute.
